As the Supreme Court prepares to issue a ruling in the high-stakes birthright citizenship case, Trump v. Barbara, Texans for Strong Borders hopes to see a decisive victory slam the door on one of the most exploited loopholes in our broken immigration system. In addition to the illegals who give birth on US soil, this loophole also resulted in an industry known as “Birth Tourism”. Birth Tourism has been banned in theory, but bad actors are still enabling this practice.
President Trump’s Day One executive order aimed to restore the original meaning of the 14th Amendment by ending automatic citizenship for children born in the U.S. to illegal aliens or temporary visa holders. This was a direct strike against the “anchor baby” incentive that encourages illegal immigration and burdens American taxpayers, workers, and communities.
Birth tourism makes the abuse even more glaring. Wealthy foreigners, particularly from China, treat U.S. citizenship as a paid service—arranging trips specifically so their children gain American passports, benefits, and future chain migration rights without any real tie to our country. Some schemes have gone as far as arranging births on vessels cruising within U.S. territorial waters along the coastline, granting citizenship without the mother ever setting foot on American soil.

- Senator Mike Lee has stated the case will be “close”
- Moderate Republicans like Nikki Haley and Tim Scott have criticized Birthright Citizenship.
The stakes couldn’t be higher.
A total victory would be the Supreme Court affirming Trump’s executive order outright—shutting down the loophole and sending a clear message that the 14th Amendment was never meant to grant citizenship to the offspring of those who entered illegally or on temporary status. Even if the ruling falls short of fully upholding the order, it wouldn’t be catastrophic as long as it leaves the door open for Congress to pass a bill on the matter.
The real doomsday scenario is if the justices enshrine birthright citizenship as an unassailable constitutional right, overriding the executive order and making meaningful reform nearly impossible without a constitutional amendment. That would create a permanent magnet for illegal immigration and chain migration, which the cartels would exploit, turning a policy debate into a locked-in feature of our republic that no future president or Congress could easily touch.
Trump took bold action on Day One. Now it’s up to the Court to back it, or let Congress finish the job.
