Governor Abbott must Formally Declare an Invasion at the Border under Article I, Section 10 of the U.S. Constitution

Declaring an Invasion under Article I, Section 10 is vital to combating the lawlessness at the Texas-Mexico border while the Federal Government fails to act.

HOUSTON, TEXAS July 7, 2022 – Today, Texas Governor Greg Abbott announced in a press release that he will authorize the Texas National Guard and the Texas Department of Public Safety (DPS) to directly interdict illegal aliens entering the United States between ports of entry and “begin returning illegal immigrants to the border to stop this criminal enterprise endangering our communities.” Governor Abbott went on to cite Article I, Section 10 and Article IV, Section 4 of the US Constitution, outlining the failure of the federal government to secure the border and the corresponding power of the State of Texas to repel an invasion without waiting on the federal government to act. While we applaud Governor Abbott for finally acknowledging this power of the state and the lawlessness of the now-open Texas border that has characterized the Biden Administration, this action does not go nearly far enough.

Under this plan, Texas Guardsmen and law enforcement officers will be put in harm’s way apprehending illegal aliens, only to release them to federal agents at ports of entry, where they will be summarily processed and released into the interior of the country under the dereliction of duty of Biden’s Department of Homeland Security Secretary Alejandro Mayorkas. In summation, this is Catch and Release with extra steps.

This falls short of the desire of Texas Republican voters for Governor Abbott to use his authority under the Constitution to declare an invasion and secure the Texas Border from illegal entry.

According to a recent poll conducted by Defend Texas Liberty PAC, 85 percent of Texas Republicans said they wanted the governor to declare an invasion and use his authority under the U.S. Constitution to secure the Texas Border.

Texans for Strong Borders PAC President Chris Russo issued the following statement:

“Governor Abbott must exercise his authority as Governor to formally declare an invasion at the border and mobilize state resources to directly return illegal aliens to Mexico. Arizona Attorney General Mark Brnovich has already issued a legal opinion classifying what is happening at our southern border as an invasion and we urge Texas Attorney General Ken Paxton to do the same. It’s time for Texas leaders to do everything in their power to secure the border and stop playing politics when the lives of Texans are on the line.”

Texans for Strong Borders PAC also announced the publication of a petition Texans can sign urging Abbott and Paxton to act to address the crisis.
