Major corporations like OpenAI and Instacart are using a loophole in federal immigration policy to quietly sideline American workers in favor of cheap foreign labor.
When companies want to convert H-1B visa holders into permanent residents through the green card process (PERM), they’re required by law to advertise those jobs to American citizens. These postings are typically posted for a minimum of 30 days to satisfy federal requirements in low-circulation, often foreign-language newspapers, in order to make it more difficult for Americans to find the job listings and apply, which would invalidate the companies’ claims that they could not find qualified domestic applicants.
JOBS.NOW has exposed the trend, calling out companies for “routine discrimination” against American-born workers in their own country. These job ads are technically legal under Department of Labor rules, but they’re designed to fail so companies can claim no qualified Americans applied, and proceed with sponsoring foreign workers.
