The battle for border security in Texas just got tougher. Open borders activists scored a temporary win when a federal judge blocked key parts of Texas Senate Bill 4 (SB 4) days before the law was scheduled to take effect. SB 4 passed through the Texas Legislature in 2023 and made “Illegal Entry” a state-level crime. The bill has been tied up in court for nearly three years.
After losing in the Fifth Circuit Court of Appeals, the ACLU of Texas and other left-wing groups filed a new lawsuit to kill SB 4. This time, they used two Honduran nationals, who were previously deported but now claim legal status, as the face of their case.
Federal Judge David Ezra granted them an injunction against parts of SB 4, saying that they faced a credible threat of being deported under the law before the lawsuit could be decided. The injunction covers the portions of the law making it a state crime to enter Texas illegally and setting up a state deportation process.
This is classic judicial activism designed to tie SB 4 up in endless legal warfare. The ACLU and its allies claim Texas is infringing on federal authority, while ignoring the migrant invasion that overwhelmed our border and forced Texas to defend itself like a sovereign state under emergency wartime conditions.
Leftists claim President Trump’s border crackdown makes SB 4 unnecessary, as their radical leftist allies in Minnesota and blue cities launch violent assaults on ICE agents and law enforcement. This is clearly a coordinated two-pronged attack: insist only the federal government can take action on immigration, then launch a terroristic war against the federal government when it attempts to do so. The end result leaves America undefended.
At its core, this is the Left’s familiar strategy: they lose at the ballot box with voters, so they weaponize activist judges and endless lawsuits to override the will of Texans and advance their extreme open borders agenda.
